My advocacy also involves representing defendants on direct appeal and in post-conviction proceedings in Coral Gables.  I have argued in front of the Florida Supreme Court, the Federal Eleventh Circuit Court of Appeal, and all of the Florida state appellate courts.  Over the years, I have secured many appellate reversals for my clients and been involved in numerous published opinions.  In 2005, I succeeded in having my client’s sentence overturned by the United States Supreme Court.  Some of my representative appellate cases are the following—Levy v. United States, 545 U.S. 1101, 125 S.Ct. 2542, 162 L.Ed.2d 272 (2005);  Pardo v. State, 596 So. 2d 665 (Fla. 1992);  United States v. Machado, 333 F.3d 1225 (11th Cir. 2003);  Consulate General of Mexico v. Phillips, 17 F.Supp.2d 1318 (S.D. Fla. 1998);  Hernandez v. State, 186 So. 3d 1103 (Fla. 3d 2016);  Masaka v. State, 4 So. 3d 1274 (Fla. 2d DCA 2009).  During the last 15 years, I have filed numerous post-conviction motions and have succeeded in having many convictions and sentences set aside.  Some of my cases have received attention in the local and national media, and I have been quote in the New York Times and appeared on the Today show.

Practice Areas

DUI

A DUI case in Florida now involves two separate but parallel proceedings—the administrative driver’s license suspension case and the in-court criminal case. Unless you take steps to defend yourself in both proceedings, you can end up with a suspended driver’s license, even if you succeed in getting the criminal charges dropped or dismissed.

Appellate Practice

My appellate work has taken me to all five Florida Courts of Appeal, the Florida Supreme Court, four Federal Circuit Courts of Appeal, the United States Supreme Court and five other states (Arizona, California, Illinois, New York, and Washington). Appellate practice is difficult and demanding—no appellate attorney wins all his or her cases—but it is professionally rewarding as well. There is no better feeling than opening up an appellate court letter (or e-mails now, as all appellate courts have adopted electronic filing) to discover I have won a reversal of a conviction and/or sentence for my client.

Drug Offences

Not all drug cases involve large amounts of drugs. Most of the drug cases filed in the state Courts involve possession of drugs for personal use. Often, the people charges in these cases need help not only with navigating their way through the criminal justice system but also with personal drug addiction issues. Luckily, most jurisdictions in Florida have drug courts designed to assist first-time offenders in getting help with both their legal and personal problems.

Criminal Law

When I accept the responsibility of representing someone in a criminal trial-level case, I enter into the representation with the ultimate goal of getting the case dropped and expunging any history of the arrest and/or court proceeding from my client’s record. There are several ways to accomplish this goal.

Juvenile

In Florida, however, many 16 and 17 year-olds are tried in the adult courts under the “direct file” system. Statistics show Florida leads the nation in trying juvenile cases in the regular adult criminal courts. While juveniles gain all the Constitutional rights available to adults when they are tried as an adult, they also are subject to adult penalties, which can be quite draconian in Florida.

White Collar

As mentioned in the “Fraud” section, Miami-Dade County is considered by many in law enforcement to be one of the fraud capitals of the United States. These fraud charges include Medicare Fraud, Medicaid Fraud, Insurance Fraud, Mortgage Fraud, Bank Fraud, Passport Fraud, Driver’s License Fraud, Worker’s Compensation Fraud, Tax Fraud, Credit Card Fraud, Counterfeiting, Official Misconduct, Title Fraud, Art Fraud, Contractor Fraud, and Identity Fraud.
